ResMed, Inc has filed parallel legal actions with the International Trade Commission (ITC) and in US federal court to stop the infringement of ResMed patents by APEX Medical Corp and Medical Depot, Inc.
ResMed is a manufacturer of respiratory and sleep-disordered breathing products. Through the legal action, ResMed has asked the ITC to stop the importation and sales of these products in the United States and has asked the US federal court to stop the infringement and award damages against the defendants.
"For more than two decades, ResMed has generated significant advances in innovative products for sleep-disordered breathing therapy," said ResMed global general counsel and chief administrative officer David Pendarvis. "We invest over a hundred million dollars in research and development each year to fuel these advances and other companies should not be allowed to infringe ResMed's intellectual property by using our technology."
